Casual Employment Changes

Fair Work Legislation Amendment (Closing Loopholes) Bills passed both houses of Parliament, as of February 2024 and the various provisions are currently coming into effect. From August 26th there will be significant changes to casual employment laws, such as:
- How casual work is defined.
- The pathway to permanent employment.
- Employee and employer responsibilities .

Before the changes take effect in August 2024, employers should ensure they are obliging with the new legislation. They need to review their casual workforce and identify employees' statuses according to the new and intended definition, which now emphasizes how the relationship operates in practice. Employers should also review template employment contracts for casual employees to remove references to current casual conversion arrangements that will no longer be applicable post-August 2024. Additionally, they must consider whether existing casual conversion processes and procedures comply with the new laws and make necessary amendments. Finally, employers should diarise obligations to update and issue casual employment information statements at the required intervals.
