Can you force employees to work on Public Holidays? Questions around employees working public holidays come in volumes, as Easter and other highly
anticipated public holidays approach. A recent ruling of the Full Court of the Federal Court of Australia
in Construction, Forestry, Maritime, Mining and Energy Union v OS MCAP Pty Ltd [2023] FCAFC 51 (the
Decision) has reminded employers that they can only request that their employees work on a public
holiday and that the employee can refuse such a request if the refusal is reasonable. The Decision has
already raised a multitude of questions relating to how work on public holidays is to be arranged, so we

Managing the Risk of Psychosocial Hazards at Work In June 2022 the model WHS Regulations were amended by Safe Work Australia to clarify employer’s

New OHS Issues in Victoria As members will be aware, in March this year, new amendments to the Occupational Health
and Safety Act 2004 (Vic) (OHS Act) expanded the health and safety review requirements for
labour hire workers and their hosts.
